 By clicking your consent, filling out intake form, and/or exchanging funds for services with Frankie Berger Dog Training in consideration of the services rendered by Frankie Berger Dog Training to my dog(s), I acknowledge reading, understanding, and accepting the statements herein. If you do not agree to all statements, please contact Frankie Berger Dog Training directly for more information.  

 I understand certain programs that my dog may participate in, including hikes, walks in public spaces, service dog public access training, obedience training, boarding, scent work, obstacle course, one-on-one play, movement within and outside the facility, and transportation to and from Frankie Berger Dog Training involve risk and possible injury, including but not limited to: Exposure to parasites, viruses, and other medical conditions passed from dog-to-dog or person-to- dog; Sprains, strains, bites, broken bones; Fatigue, dehydration, nicks, cuts, or death. 

I further understand that not each and every potential risk can be listed above but, nonetheless agree that the activities associated with dog socialization outweigh the possible risks, therefore, I hereby voluntarily release, forever discharge, and agree to hold harmless and indemnify Frankie Berger Dog Training and its agents, successors, heirs, from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my dog’s participation in activities at Frankie Berger Dog Training, including those allegedly attributable to the negligent acts or omissions of Frankie Berger Dog Training.

Further, I understand that I may be exposed to certain risks when bringing my dog to participate in activities at Frankie Berger Dog Training or when picking up my dog and or dropping off from participating in activities at Frankie Berger Dog Training. Such risks may include property damage and/or physical injury inside or outside the facility, such as from falling, slipping, illness, and/ or dog bites. Therefore, I hereby voluntarily release, forever discharge, and agree to hold harmless and indemnify Frankie Berger Dog Training, its agents, successors, heirs from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my dog’s participation in activities at Frankie Berger Dog Training, including those allegedly attributable to the negligent acts or omissions of Frankie Berger Dog Training. 

 If my dog is ill or injured while participating in activities at or with Frankie Berger Dog Training, Frankie Berger Dog Training will make every reasonable effort to reach me pursuant to the contact information I have provided Frankie Berger Dog Training. However, if Frankie Berger Dog Training is unable to reach me, I consent to Frankie Berger Dog Training seeking appropriate veterinary care and I accept responsibility for any and all associated expenses. Frankie Berger Dog Training will not pay any portion of veterinary expenses associated with seeking medical care for my dog if so necessary. Allergies, Special Diets, and Medications I agree that I will disclose to Frankie Berger Dog Training any allergies my dog may have. I further agree to disclose to Frankie Berger Dog Training any special dietary needs or medications my dog may require if necessary during activities at Frankie Berger Dog Training.  

 If a client fails to give at least 24 hours notice cancellation notice, or is not present at the time of scheduled appointment, the client will not be permitted to schedule again until full session balance as quoted is paid via Square invoice. If session is part of a package purchase, the session will be counted as one session. If a client is more than 20 minutes late to the appointment, the trainer has the right to refuse the session.  

 I accept the responsibility of paying for any damage to facility, property, and/or equipment caused by the dog.  

 These agreements, waivers, and authorizations will remain valid and in force as long as and whenever my dog participates in any activity at or with Frankie Berger Dog Training.  

 This agreement between the paying client (hereinafter referred to as “Client”) and Frankie Berger Dog Training (hereinafter known as “Trainer”) pertains to the following: The client’s dog (hereinafter referred to as “Dog”) for good and valuable consideration, the parties agree as follows: Training Fees: a. Client agrees to pay Trainer amount agreed upon by all parties at consultation session (as scheduled) and understands all sales are final, regardless of use of services. Sessions that have been paid for can be attributed to alternative services within Frankie Berger Dog Training at Trainer's discretion. All sessions must be completed within 365 days from the date of commencement of contract or they will be forfeited. Services: Trainer will make every reasonable effort to help Client achieve training and behavior modification goals but makes no guarantee of Dog’s performance or behavior as a result of providing professional animal behavior consultation. Client understands that he/she and members of the household must follow Trainer’s instructions without modification, work with dog daily as recommended, and consistently reinforce training being given to Dog. Cancellation Policy: If Client fails to give at least 24 hours cancellation notice, or is not present at time of scheduled appointment, session fees are still due. For a package deal, the session will still be counted as one session. Liability: If Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses. At Trainer's sole election, Trainer's duties hereunder shall terminate if (a) in Trainer's sole judgment Dog is dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect. This Agreement is binding upon Client, spouse of Client, and children of Client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both Client and Trainer.

By purchasing services from Frankie Berger Dog Training, I acknowledge that if my dog is or I am hurt or property is damaged during my dog’s participation activities at Frankie Berger Dog Training, I may be found, by a court of law, to have waived my right to maintain a lawsuit against Frankie Berger Dog Training on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read and fully understand this entire document and I agree to be legally bound by its terms.
